These terms and conditions apply to the Contest and aspects thereof (“Terms & Conditions”).

Any Customer participating or seeking to participate in the Contest shall individually be referred to as “Participant” and collectively be referred as “Participants”.

Subject to the eligibility criteria contained herein, the Contest is open to participation by all Indian citizens currently residing in India. Children should attempt these dares (“Dares”) under adult supervision. Any participant below the age of 18 years on the start date of the contest shall only be eligible for Mini Prize and not the Mega Prize.

The Contest will be valid from 00:00:01 on 03-11-2022 (Start Date) to 23:59:59 on 04-02-2023 (End date). Britannia reserves the right to cancel/amend/extend the Contest Period without giving any notice or intimation. No claims or questions shall be entertained in this regard.

In order to participate in this Contest, Participants have to record a video of himself/herself while performing the “Dare/s” and uploading the same on their Instagram handle & tagging @britanniagoodday_ with #GoodDare. Every unique and eligible video posted by a participant on Instagram will be considered as one Entry. (“Entry”). In case of two or more participants posting the same video as an entry, the first entry to be received/posted will be considered for evaluation.

Upon receipt of an entry from the participants, Britannia at the end of the contest shall evaluate the entries and select 6 Mega winners and 400 Mini winners (Collectively called as “Winners”). The decision of Britannia with respect to declaring winner/s shall be final and conclusive. No question, complaint, dispute or concern raised by the participants for any reasons whatsoever including but not limited to the process of selection or rejection shall be entertained.

6 Mega winners will stand a chance to win “Mega Prize” on the basis of the “Dare” that they perform. All the 6 Mega winners will get a trip to the respective locations. This trip includes a return flight (ex-Mumbai), 2 nights 3 days stay at a three-star hotel or equivalent, visa fee and ticket to Lord’s museum/Chocolate museum/Opera house respectively.

400 Mini winners will stand a chance to win one of the “Mini Prizes”. The mini prize shall be based on the Time Period in which the entry has been received. The prize will be procured by our agency partner Coral Media (“Agency”) and sent to the addresses provided by the winners. Britannia or the agency will not be able to deliver and will have to cancel the prize in case that the top courier services like Blue Dart or DTDC does not have coverage on the pin code provided by the winner. Once the prize is ordered, Britannia or the agency will not be responsible for any deficiency of service by the courier service. In the event that the prize becomes unavailable on top ecommerce websites (Amazon and Flipkart), then an alternate prize of a similar value will be given to the winners. The choice of the alternate prize will rest with Britannia, and the winner will not have any say in the same. Britannia or the agency will also not be responsible for the replacing, repairing or refunding in case of any defect with the prize. The Company shall not entertain any claim, complaint or dispute for the reasons of non-delivery by courier service for the issues attributable to the Winner.

Every winner shall be eligible for only one Prize. However, the participant can send multiple entries for the Contest.

The Contest is subject to all applicable central, state and local laws and regulations.

The participants will have to provide their PAN Card details upon being shortlisted. In absence of a PAN Card, the participant should provide a Government ID proof such as Passport (validity of 6 month or more), Aadhaar Card, Driving License or a Voter Card along with a declaration of non-availability of PAN Card. The winners will be announced post verification of PAN/ID proof. In case the winner is unable to get a visa, Britannia shall not be held responsible. All the documents required for VISA application shall be furnished by the winner himself/herself with complete due-diligence. Britannia will have no control/supervision or authority over visa application & any rejected visa application will lead to cancellation of the prize.
The winners who will be travelling abroad will have to abide by all relevant country COVID protocols.
All the winners travelling abroad will be required to furnish NOC/undertaking in the format shared by Britannia with the winners before their travelling dates.

The prize under this Contest can’t be traded, sold, replaced or adjusted with anything including other prizes, other gifts or cash.

No request of rescheduling the dates or extension of the prize or replacement of the voucher shall be entertained by Britannia.

Demanding of PAN Card or other details is a part of the selection process and it does not mean that the entry has been finalized or the participant has been selected or that the Prize is guaranteed.

By participating in the Contest, the Participants fully and unconditionally agree to and accept these Terms and Conditions which are available on www.gooddare.in (“Contest Website”). The decisions of Britannia will be final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein.

Britannia reserves the right to exclude any person from participating or winning the Contest on grounds of misconduct or for any other reasons, as it may deem fit and proper. Any entry that is abusive or sexually explicit or disrespectful to any community/religion/place/person will be disqualified and such comment will be reported to the relevant authorities and appropriate action shall be taken against such miscreant. No communication in this regard will be entertained.

Britannia reserves the right to terminate, modify or extend the Contest and/or deletion or addition of any of the terms and conditions of the Contest at any time at its absolute discretion, without advance notice and / or assigning any reason thereof. Britannia may amend the type of Contest, submission mechanism, eligibility criteria, term of the Contest, and the prizes for the Contest; Britannia reserves the right to amend, temporarily suspend or withdraw the Contest in its absolute discretion provided that Britannia shall not exercise this right unreasonably. All decisions of Britannia in respect of the Contest and the prizes therein will be final, binding and conclusive.

All intellectual property rights including trademark, copyright and designs used are the property of Britannia. All stories/entries submitted by the participants in connection with the Contest are assigned to Britannia upon submission and become the property of Britannia. Britannia may use the material in any medium in any reasonable manner it deems fit. Copyright in any such material remains the sole property of Britannia and Britannia may use such material in any medium in any manner it deems fit and no claim from the Participant in this regard shall be entertained.

Any winner, if restricted to travel to the selected destination for any reasons beyond the control of Britannia, shall stand disqualified and their respective entry shall stand cancelled. Britannia shall neither change the destination nor arrange a different prize or compensate or provide any other monetary relief to the winner.

This Contest will be open to every Indian citizen residing in India, however, only a participant who has attained the age of 18 years on or before the start date of the contest shall be eligible for Mega Prize. Delivery of the Prize is subject to the area of delivery that is serviceable by top courier services such as Blue Dart or DTDC.

Subject to other criteria and conditions stated in the terms of the Contest, the Contest will be open to all residents of India with the exception of employees of Britannia, their respective agents, distributors, retailers and any other channel partner of Britannia, and their immediate family members.

Britannia will not be liable under any NDNC (National Do Not Call) Registry / DND regulation or such other regulation that exists or may come into play. Participants agree to receive communications related to the Contest even if they are registered under NDNC, DND (Do Not Disturb), or under any other similar regulation, Britannia or its Agency will have all the authority to call the Participant by virtue of them having voluntarily participated in the Contest.

It is advised to exercise caution while doing or performing any dare. Excessive consumption is not recommended while doing/performing any dare.

Kids who want to participate in this contest shall need their parental permission before selection.

The eligibility of Mini Prizes shall be based on the Time Period in which the entry of the Participants is received. Winners of mini prizes will get the prizes set for that particular Time Period only.

Time of participation will be defined as the time at which the entry is received in the system of Britannia. Entries coming on the relevant Time Period shall be eligible for Mini prize for that Time Period only.

Entries coming outside the Contest period will not be eligible for the Contest.

The Prize/s under this Contest are free of cost and the Participants are not required to pay for the same or send any money or share any Bank or Card details with Britannia. Britannia shall not be responsible if any money is paid, transferred or bank/card related details are shared by the Participant.

In order to participate in this Contest, Participants have to record a video of himself/herself while performing the “Dare” and uploading the same on their Instagram handle & tagging @britanniagoodday_ with #GoodDare. Every unique and eligible video posted by a participant on their Instagram handles will be considered as one Entry. (“Entry”). In case of two or more participants posting the same video as an entry, the first entry to be received/ posted will be considered for evaluation.

Britannia shall not be responsible for (including but not limited to):

• a. Any lost, late, or misdirected computer transmission or network, electronic failures, or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
• b. If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry
• c. Other conditions beyond its reasonable control

During the Contest Period, a participant can participate/ submit any number of entries, however, one participant can win only one Prize.

The winners shall be selected at the sole discretion of Britannia and the same cannot be challenged under any circumstance. The decision of Britannia shall be final and binding on the Participant in this matter. Britannia shall in no case entertain any questions, correspondence, enquiries, etc. on the manner of the selection and the Contest.

Britannia or its Agencies shall not be liable for any delay due to Act of God, Governmental action, Force Majeure circumstances and/ or any other reasons which are beyond the reasonable control of Britannia, and under no circumstances, we shall be liable to pay any compensation whatsoever for such losses.

Britannia reserves the right to extend/cancel / postpone /stop this Contest at its discretion or change all or any part of terms and conditions that are applicable, without giving prior intimation of any kind and being liable for any consequential losses/damages. Britannia will not be liable or responsible for any damages, losses, costs, expenses or otherwise suffered by any of the winners and/or companions during the course of the presentation/travel. By entering the Contest the Participant hereby releases from and agrees to indemnify Britannia, and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the prize or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.

Britannia accepts no liability, whether jointly or severally, for any errors or omissions, in relation to winning the Contest. The Participant shall be solely responsible for any consequences which may arise from his/her participation in the Contest. Participant also undertakes to indemnify Britannia and its officers, directors, employees and agents on the happening of such any illegal acts committed by the Participant and any third party claim arising therefrom (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Britannia on account of such act on the part of the Participant. In consideration of Britannia allowing the Participant/s to take part in the Contest, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Britannia, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Contest or related to the Contest or the prize of the Contest.

Britannia reserves the right to alter the dates pertaining to the Contest, announcement of winners, participation criteria, prizes, and the terms and conditions of the Contest without notice, including any explanation thereof and further without being liable for any claim, including in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated or any other event outside of the Britannia’s control. Britannia reserves the right to exclude any person from the Contest on the grounds of misconduct or criminal record.

The Participant/s undertake and irrevocably and unconditionally permit Britannia to cover the Contest through various media including newspapers, radio, television, news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.

Each Participant understands and agrees that their entries may be used by Britannia in any manner whatsoever. All the rights including but not limited to the intellectual property rights, copyrights and all other allied, ancillary and subsidiary rights in the entry/ies shall vest with Britannia absolutely for perpetuity, throughout the world.

Britannia, will collect Participant’s personal information in order to conduct the Contest. If the information requested is not provided, Participant understands that the Participant would not be eligible to participate in the Contest. By entering the Contest, unless otherwise advised, each Participant also agrees that Britannia or its affiliates may use this information, or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the participant. Participants' personal information may be disclosed to government authorities and winners' names may be published.

All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with Britannia at all times. Britannia or any person or entity permitted by Britannia shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Britannia upon submission and become the property of Britannia exclusively. Britannia may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Britannia.

Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

No queries, claims, dispute, complaints or grievances shall be entertained by Britannia after 30 days from the date of the closure of the contest.

A participant can win a maximum of 1 prize during the contest period.

The prize cannot be exchanged and is not transferable and cannot be converted into cash.

Any entry that is abusive or sexually explicit or disrespectful to any community/religion/place/person will be disqualified and such comment will be reported to the relevant authorities and appropriate action shall be taken against such miscreant. No communication in this regard will be entertained.

Britannia reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Britannia in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and conclusive.

Britannia shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.

Britannia shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.

Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of Britannia.

If a person chooses to access the Contest Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.

The participation in the Contest is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.

The entry, comments of winners or any other materials sent to Britannia including feedback and other communications of any kind shall be deemed to be non-confidential. Britannia is free to reproduce, distribute and publicly display such feedback and entries received towards this Contest without limitations or obligation of any kind. Britannia is also free to use any ideas, concepts, know-how or techniques contained in such feedback for any purpose. Britannia reserves the right to analyse and summarize data that is collected and also reserves the right to publish, distribute, share summaries of the data collected with sponsors or other business partners without limitations or obligations of any kind subject to applicable laws.

Failure to comply with any of these terms and conditions (including instructions) will disqualify Participant from continuing to take part in the Contest and such Participant's participation will be invalid. Britannia retains the sole discretion to refuse participants the right to participate if it is of the view that these terms and conditions are being violated.

Britannia shall not be liable to award/compensate/exchange or in any manner pay or Contest in case Britannia fail to provide subscription under this Contest due to any cause beyond their reasonable control or foresight, including but not limited to: act of god, insurrection or civil disorder, religious strife, war or military operations, terrorist act, partial or total strikes, either internal or external, lock-out, epidemic, blockage of means of transport or of supplies, national or local emergency, earthquake, fire, storm, flood, water damage, governmental, regulatory or legal restrictions, area being unserviceable by Premium Courier or Postal Services, or act or omissions of persons for whom Britannia is not responsible.

By entering this Contest, Participants agree to hold harmless Britannia, its agencies and its affiliates, against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) Participant's participation in the Contest; (ii) the selection criteria or process; (iii) the administration of the Contest; (iv) delivery of the prize for reasons not attributable to Britannia and (v) the quality, warranty, functioning or anything relating to the prize. Participant’s hereby release, waive and discharge any and all claims of damage, loss or causes of action (including negligence) including but not limited to loss or damage to person or property which the Participant and his/her representatives or assignees may have, suffer or which may hereinafter accrue to the Participant or as a result of the Participants participation in the Contest or use of the subscription.

Britannia reserves the right to disqualify any Participant who tampers with the entry process or submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Britannia, engaged in conduct in entering or participating in the Contest which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Contest and/or Britannia.

Britannia shall not be responsible for late, falsified, delayed, incomplete or destroyed entries and all such entries are void and may be disqualified at any time. Britannia does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, lost delayed or garbled data or transmissions, omissions, interruptions, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry materials/ data that have been tampered with or altered are void.

All participants acknowledge that the Prize will be taken as offered and cannot be varied. Any unused prizes are not-transferable, non-refundable and non-redeemable for other goods or services and cannot be exchanged for cash or kind.

Britannia is not liable for any problems, errors, or negligence that may arise or occur in connection with this Contest, including but not limited to, any damage to the Participant's computer or other technical device, or software, as a result of the Participant's participation in this Contest. Britannia shall not be liable in any way for any failure or breach by any party in connection with this Contest, prize or prizes and accepts no responsibility for any loss suffered by a participant arising from this Contest, prize or prizes.

The Participants acknowledge that the quality of the prize, and the services of the courier service are not controlled or supervised by Britannia or its Agency, hence any issue with relation to delay in delivery or damage in transit shall have to addressed to the Courier delivery partner and manufacturing defect in product or product related services shall have to addressed to the manufacturer of the product alone and Britannia or its Agency shall not be held responsible for it.

Britannia and/or any agency appointed by it, will collect Participants' information in order to conduct the Contest and subsequently for verification of identity of the Participant. If the information requested is not provided, the Participant would not be eligible to participate in the Contest. By entering the Contest, unless otherwise advised, each Participant also agrees that Britannia, agency appointed by it to carry out the Contest or aspects thereof, and/or Britannia’s affiliates may use this information, or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Participant. Participants' personal information may be disclosed to government authorities and winners' names may be published.

The information each Participant provides will additionally be used for the purposes of administering this Contest. All rights are reserved.

If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Indian laws shall be exclusively applicable to any and all disputes arising out of or in connection with the Contest or these terms and conditions.

The interpretation and implementation of the Terms and Conditions shall be at the sole discretion of Britannia. The decisions of Britannia with respect to aspects of the Contest shall be final and binding, and not subject to challenge or appeal.

These Terms shall be governed by & construed in accordance with the applicable laws in India. Any dispute including any dispute arising out of all matters with respect to this Contest are subject to the jurisdiction of the Courts at Bangalore only. All the disputes/complaints/queries, if any, shall be entertained only within one month of the contest getting over. Any winner coming to Britannia with any disputes/complaints/queries after the expiry of the aforesaid one month shall not be considered for resolution. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or Britannia and/or agencies/sponsors associated with this Contest, shall be governed and construed in accordance with the laws of the Republic of India.
